Privacy Policy

Aster Enterprises d.b.a. Ueblo (the "Company") is committed to maintaining robust privacy protections for its users. Our Privacy Policy ("Privacy Policy") is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service. For purposes of this Agreement, "Service" refers to the Company's service which can be accessed via our website at Ueblo.com or its subdomains or through our mobile application, providing kiosk-based visitor information, waiting lists, student-focused data, analytics and services. The terms "we," "us," and "our" refer to the Company. "You" refers to you, as a user of Service. By accepting our Privacy Policy and Terms of Use, you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy.

I. INFORMATION WE COLLECT

We collect "Non-Personal Information" and "Personal Information." Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information includes only your email, which you submit to us through the registration process at the Site. Information collected via Technology To activate the Service you do not need to submit any Personal Information other than your email address. To use the Service thereafter, you do not need to submit further Personal Information. However, in an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the "referring URL"), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user's browser from our servers and are stored on the user's computer hard drive. Sending a cookie to a user's browser enables us to collect Non-Personal information about that user and keep a record of the user's preferences when utilizing our services, both on an individual and aggregate basis. For example, the Company may use cookies to collect session preferences such as current page within the app and view. The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. Information you provide us by registering for an account In addition to the information provided automatically by your browser when you visit the Site, to become a subscriber to the Service you will need to create a personal profile. You can create a profile by registering with the Service and entering your email address, and creating a user name and a password. By registering, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy. This Application does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.

II. HOW WE USE AND SHARE INFORMATION

Personal Information: Except as otherwise stated in this Privacy Policy, we do not sell, trade, share for marketing purposes, or otherwise rent your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user's email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers. Non-Personal Information In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non- Personal Information to our partners, advertisers and other third parties at our discretion. In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. You may opt out of the new information practices at any time by terminating your relationship with us before new information practices are put in place. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.

IV. YOUR RIGHTS REGARDING THE USE OF YOUR PERSONAL INFORMATION

You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. Ueblo.com ("the Site"), including any/all related websites and services are provided by Aster Enterprises LLC, d/ b/a Ueblo ("Ueblo"). The Site is a website, mobile site and/or application for individuals, students, businesses and business/organization staff/employees/ faculty members providing resource-based status information, communication, resource-focused data, analytics and services (“Services”). The Site contains limited personal information identifying individuals, staff, and other users, including but not limited to general content related to service-levels, usage records, and the like intended to be accessed by businesses staff/employees & members, as well as content that is only intended to be available to users that log in and is accessed by entering a User ID and password.

2. Legal Notices

2.1 If you are browsing and/or inputting information into this Site as a user, you may access material displayed on the Site for your non-commercial, personal use only and subject to the Terms stated below.

2.2 If you are browsing and/or utilizing this Site as a business, staff/faculty member/ employee, you may access or download material and/or content displayed on and/or generated by the Site only in accordance with the Terms stated below. 2.4 You agree that these Terms shall be governed by and construed in accordance with Florida law, and you hereby submit to the exclusive jurisdiction of the Circuit Court in and for Leon County, Florida, in relation to any dispute or matter arising out of or connected with this Agreement.

2.5 This Agreement contains the entire agreement between you and Ueblo regarding the use of the Site.

2.6 The invalidity, illegality or un-enforceability of any provision of these Terms shall not affect or impact the continuation in force of the remainder of the Terms.

3. Anti-Spam Notice

Publication of electronic addresses on the Site is for the purpose of professional communication only and must not be used to infer consent to the receipt of unsolicited commercial electronic messages.

4. Eligibility

By using the Site, you represent and warrant that (a) all registration/personal information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are a front-end user, business, and/or full- time or part-time staff/member of the business / organization authorized to utilize the Site for its intended purposes.

5. Registration of user account

5.1 In order to access certain parts of this Site and utilized Services provided thereby, you may be required to register a user or subscriber account with a log in email address and password. You may terminate your Ueblo usage at any time for any reason. Ueblo reserves the right to immediately, without notice or reason, suspend or terminate your access to the Service in its reasonable discretion.

These Terms are subject to change by Ueblo at any time. Any changes will appear on this terms and conditions page, which can be accessed from any page on the Ueblo Site. If the Terms change, and you do not notify us to the contrary, your continued use of the Site constitutes your acceptance of the amended Terms.

8. Fees

Notwithstanding the fact that the Site may be initially offered as a free service, you acknowledge that the Site reserves the right to charge for the Services and to change its fees from time to time at its discretion. If Ueblo terminates your usage privileges because you have breached these Terms, neither you nor the business/ organization shall be entitled to the refund of any unused portion of fees.

As a user of the Site, you agree:

9.1 That you are solely and entirely responsible for any content and/or information (personal and/or otherwise) you post and/or access on the Site, or any content or information you transmit or otherwise communicate to any other third-party;

9.2 To use the Service in a manner consistent with any and all applicable laws and regulations;

9.3 That Ueblo shall have no liability whatsoever for the unauthorized use and/ or access of/to any information (public and/or non-public) including, but not limited to, telephone numbers, addresses, surnames (family names), URLs, email addresses or other information on the Site that could be used to identify you or anyone else;

9.4 Not to post, distribute, reproduce or communicate in any way any copyrighted material, trademarks, or other proprietary information in any related to the Site, all of which you acknowledge is owned by Ueblo, without obtaining full, valid and verifiable prior consent of the owner of such proprietary rights;

9.5 That you are solely responsible for your interactions with other users of the Site; and

9.6 Not to disrupt, modify or interfere with the Service or its associated software, hardware and/or servers in any way, and you agree not to impede or interfere with the other users of the Service. You also agree not to alter or tamper with any information or materials on, or associated with, the Service.

10. Online Content/Data

10.1 The Service interfaces in real-time through various networked clients and servers. It requires an active internet connection on each networked device. It employs modern web technologies such as SSL, isomorphic computing, distributed computing, and single-page reactivity for secure and seamless client-side data computation and rendering. The Service maximizes computations and sustainability by allocating calculations between available client resources. To ensure that clients are kept in sync and up to date, it uses web-sockets in the browser, where available, with long-polling as a fallback.

10.2 Under no circumstances will Ueblo be responsible for any damage or loss arising or resulting from anyone's reliance on information or other content/data shown on the Site, or your failure to comply with these Terms including clause 9 or transmitted or otherwise communicated to third-parties.

10.3 Warning: notwithstanding Ueblo’s security protocols, it remains possible that unauthorized third-parties (including, but not limited to “hackers”) could potentially access the Site and post, transmit and/or otherwise access information and/or data contained therein, and as a user of the Site you may involuntarily be exposed to such threats, including the risks that others could obtain some personal information about you through your use of the Service, and that the recipient may use any such information to harass or injure you. By using the Site, you expressly recognize and agree that Ueblo is not responsible for the use of any personal information that you may choose to disclose on the Site - you do so entirely at your own risk. Ueblo will not itself use your personal information except in accordance with our published Privacy Policy.

10.5 Ueblo reserves the right, but has no obligation, to monitor any materials posted in any public areas of the Site. Ueblo retains the right to remove any such material that violates, or is alleged to violate, the law, or this Agreement (including in breach of clause 10.4 in its own opinion in its entire discretion).

10.6 The Service will treat written digitial communications sent between you and other Members that are not readily accessible to the general public as private.

11.1 Ueblo owns or has the right to use all proprietary rights in the Site. The Site contains the intellectual property, copyrighted material, trademarks, service marks and other proprietary information (registered and unregistered) of Ueblo and its licensors.

11.2 Except for that information for which you have been given verifiable permission to use, you will not copy, modify, display, publish, perform, transmit, distribute or sell any such proprietary information.

11.3 By posting information or content on any public area of the Site, you automatically grant, and you represent and warrant, that you have the right to grant: to use, reproduce, modify, translate, transmit, and distribute any information or material that you supply or communicate to the Service, in any such medium now in existence or hereafter developed, for any purpose, including commercial uses. information and content.

Ueblo makes no warranties or representations as to its accuracy and, to the extent permitted by law, Ueblo specifically disclaims any liability or responsibility for any errors or omissions in the data/content on the Site. Neither Ueblo nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the Site whether due to a breach of contract, breach of warranty, negligence, or otherwise even if Ueblo has been notified or advised of the possibility of such damages.

13.3 Except as otherwise stated in the text of a webpage of this Site or as required by law, everything on the website and all Ueblo products and Services displayed on the website are provided to you "AS IS" and, to the extent permitted by law, is provided WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13.4 Ueblo assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site (including accessing hyperlinks) or your downloading of any materials, information, data, text, images, video, or audio from the Site. Ueblo also assumes no responsibility, and shall not be liable for any interruptions, delays, damages, or errors in access to the Site or the accuracy, timeliness, completeness, security or reliability of any reports, communications (including, without limitation, any transactions) made through or in relation to the Site. 13.6 Any data costs associated with accessing the Site remain your responsibility and are dependent on the service provider used.

Ueblo reserves the right to terminate your usage of the Site at any time if we determine and/or have reasonable basis to believe that you have violated any of these Terms, in Ueblo sole discretion.
